  • RAS and MAR successfully defeated a claim for attorney’s fees requested in a declaratory judgment action regarding an easement dispute.
  • Janina Wojtkowski obtained a summary judgment dismissing a family restaurant from a dram shop case (claim of over-serving a minor), showing that the restaurant was not liable because it maintained proper procedures.
  • Janina Wojtkowski successfully defended in a real estate case centered on misrepresentation of seller’s disclosure and subsequently defeated the plaintiff’s Motion for New Trial, ensuring the favorable original ruling was upheld and bringing the matter to a final conclusion at the trial court level.
  • Richard Simmons assisted client in resolving a payment dispute with a former client through mediation.

Real Estate & Property

  • Heather Benzenhoefer successfully negotiated and closed on a sale of a commercial property.

  • Real Estate: Prepared real estate documents which required a new survey of the property to be transferred.

Estate Planning & Trusts

  • Heather Benzenhoefer finalized a revocable trust.
  • Heather Benzenhoefer worked with multiple universities to draft and finalize documents required to establish perpetual endowments.
  • Marc Schneider completed the transfer of 2 lots owned by multiple parties into an Irrevocable Trust.

  • Estate Planning: Prepared a Transfer on Death Deed transferring property to surviving spouse upon passing with alternate beneficiaries to minimize the necessity of probate.

Family Law

  • Family Law: Successfully negotiated and settled a client’s divorce involving property dispute.
  • Family Law: Successfully obtain Temporary Orders granting Maternal Grandparents custody of their grandchild with parents having supervised visitation.
  • Montana Cortez successfully negotiated and prepared a premarital agreement for parties’ execution.

  • Family Law Partner, Vanessa J. Maduzia, successfully terminated a biological father’s parental rights in favor of Maternal Grandparents allowing the Maternal Grandparents to complete the adoption of their grandchildren.

  • Family Law Partner, Vanessa J. Maduzia, was successful in representing Petitioner mom in a highly contested custody modification case that was resolved in mediation

  • Defeated a municipality’s plea to jurisdiction, where the city sought to dismiss our client’s lawsuit seeking disclosure of a government funded report on the city’s relationship with a general contractor.

  • Attorney Mark Rubal gets a not guilty verdict from a jury in Harris County on a Domestic Violence Assault case.

  • Partner Mark Rubal and Associate Attorney Janina Wojtkowski successfully negotiated an Agreed Temporary Injunction in a business dispute with a terminated employee.

  • Successfully argued client’s Motion to Compel the Texas Estates and Health & Safety Code in County Court of Law #3 Probate Court of Brazoria County, Texas

  • On January 9, 2023 Janina Wojtkowski obtained a judgment against a painting subcontractor after the  general contractor provided initial payment, but the subcontractor failed to properly complete the project.

  • Defeated a municipality’s plea to jurisdiction, where the city sought to dismiss our client’s lawsuit seeking disclosure of a government funded report on the city’s relationship with a general contractor.

  • Associate Attorney Janina Wojtkowski successfully obtained a temporary restraining order in favor of client in a dispute with a terminated employee.
  • Successfully resolved a federal lawsuit by a home owner in a storm claim his insurance refused to pay.

  • Settled employment claim and recovered commissions owed to client by former employer.

  • Recovered tax sale proceeds from registry of court for International based client.

  • 8/31/21: RAS negotiated a resolution of a dispute over garnished bank funds frozen by a creditor who froze payments inadvertently sent to the wrong business.

  • 9/09/21: RAS negotiated the resolution of a federal lawsuit by an employee complaining of unpaid FLSA overtime pay, FMLA violations and related retaliation claims.

  • 9/10/21: RAS negotiated a resolution through mediation for payments due to a financial institution in bankruptcy with multiple lien claimants seeking priority over the limited funds available.

  • Successfully closed on short sale of large real estate tract in Ch. 11
  • Closed on acquisition of equity interest between business partners.
September:
  • Defended Motion to Impose Stay Pending Appeal facilitating client’s purchase of business out of Chapter 11.
  • Negotiated  resolution of past due rent owed by commercial tenant allowing client to remain in premises.
  • Assisted client in resolution of dispute over compensation in real estate brokerage agreement.
August:
  • Closed on $6.75M sale of oil and gas surveying business.
  • Successfully defended Motion for Contempt in contested Chapter 11.
  • Obtained a Court Order authorizing the debtor’s sale of assets in contested Chapter 11.
  • Formation of 501C new nonprofit to support aspiring authors.
February:
  • Feb 7: Confirmed two Ch 11 plans in local real estate development

  • Formed new Family Foundation.
  • Formed two new FLPs for asset protection and estate planning for high net worth clients.
  • Assisted in the sale of investment real estate involving a 1031 lease hold improvement exchange.
  • Obtained conditional approval of small business chapter 11 disclosure statement.
  • Pending motion to sell real property development in Friendswood, Texas.
  • Successfully settled a divorce in Galveston County, Texas.
  • Recently defeated a Notice of a Bill of Review in a family law case in Brazoria County on behalf of client.
  • After two years of litigation, was able to successfully settle an heirship determination case that was pending in the Probate Courts of Harris County, Texas.
  • Admitted a Last Will and Testament as a Muniment of Title four years after the death of decedent in the Probate Courts of Harris County, Texas.
  • Judicial District of Pecos County: successfully finalized negotiated agreement on multi-party bond claim ensuring pro-rata distribution of bond funds to client after certain parties sought to preclude certain claimants
  • Judicial District of Harris County, Texas: successfully negotiated resolution of claims against corporate client after insurer refused coverage.
  • Revised amendment to commercial lease for client with numerous locations throughout Texas.
  • Appointed as a Receiver with State Court order to collect on a judgment against the owner of a business.
